Sh12bn to buy MCA backing of key vote

Ward representatives are set to reap big from referendum campaigns as Government lays out the goodies to counter what’s on offer from Council of Governors and the opposition Cord alliance

CAMPAIGN Deal for office and car gift for county ward leader set to be sealed today


Kenyans may be forced to pay as much as Sh12 billion to meet the cost of offices and vehicles for thousands of ward representatives in a deal by the government aimed at scuttling the referendum campaign. Under the deal, which was to be sealed at a meeting between President Kenyatta and the County Assembly Forum (CAF) in Kwale today, the government will fund the construction of offices for all the 2,100 ward representatives.


At a projected cost of Sh3 million per unit, the government will require Sh6.3 billion to build offices for all the Members of County Assembly (MCAs).

The government will also pay the salaries of their staff, and extend car grants of up to Sh2 million to each of the ward representatives. This will set the taxpayer back by Sh4.2 billion. The cost of fuelling and maintaining the vehicles will also be met by the taxpayer.


In turn, the government expects the MCAs to reject the draft Bills set to be tabled in the county assemblies by both Cord and the Council of Governors, effectively scuttling the separate referendum campaigns. The government deal mirrors the sweeteners offered to the MCAs by the Council of Governors to secure support for the referendum campaign. MCAs who spoke to the Nation on phone confirmed that they were in talks with the Executive on the car grants and offices, and that a deal was in the offing. “MCAs have been agitating for car grants of up to Sh2.5 million, half of what MPs get because of the poor road network in most of our wards. We have also been agitating for ward offices.

Battle looms over billion-shilling properties

DISPUTE | Moi, Biwott and Kulei tussle over unidentified prime properties in Nairobi


A vicious battle for control of multi-billion-shillings in assets linked to former President Daniel arap Moi and Kanu-era Cabient minister Nicholas Biwott is taking shape after lawyers representing them wrote to a company associated with one of their key allies demanding the return of property in Nairobi allegedly held on behalf of the pair. In what sources familiar with the intrigue say could be a wider scheme to reclaim property previously held in trust by associates of Mr Moi and Mr Biwott, there are fears the dispute could end up in court and partly expose the extent of the wealth of the two individuals.

However, it is not clear why the two men have chosen to engage in legal battles at this moment in time. People close to their families say perhaps those who stand to inherit would like the property to revert to the principals from the nominees who were entrusted with it. In a letter dated June 16, 2014, Kipkenda and Company Advocates — representing Mr Moi and Mr Biwott — asked the lawyers of Belgo Holdings Ltd to return two unidentified prime properties in Nairobi worth millions of shillings that they have allegedly been holding in trust. In an interesting turn of events, one of the letters reveals that Belgo Holdings is associated with Mr Joshua Kulei, Mr Moi’s former private secretary and one of his most trusted allies.

 “Our clients are currently reconstituting trustees of their various investments. As the owners of the companies and the properties where your roles are restricted to trusteeship, our clients had verbally indicated to you that they require all titles to the trust properties held by you returned to them,” write the lawyers. The letter traces the genesis of the ownership to 1980 when individuals associated with a company that was later registered as Belgo Holdings, were allegedly asked to incorporate Lakeview Developments Ltd as the nominees and trustees of Mr Moi and Mr Biwott for the two properties. But Belgo Holdings, whose shareholders are listed as Akber Abdullah Kassam Esmail and Shirin Esmail, is accused of transferring the property to itself and shunting the interests of Mr Moi and Mr Biwott.

But Deputy President William Ruto and former Prime Minister Raila Odinga also share a striking paradox. They are the most powerful men in their communities, yet they are also held hostage by their own people’s fears and aspirations. Both have been close to power, yet they have never quite reached there. Today, these former allies are the fiercest political rivals.

Why can’t Mr Ruto and Mr Odinga ever agree on anything? This is the question some political observers have been grappling with this week, as the simmering contest between the two went a notch higher after President Uhuru Kenyatta made a conciliatory gesture towards Mr Odinga, his toughest challenger in last years general elections. The analysts were unanimous that Mr Ruto and Mr Odinga were divided by the same qualities they have in common. Former Cabinet minister Amukowa Anangwe simplified the discordance between two of Kenya’s most aggressive campaigners as “a clash of two politicians with inflated political egos”. The political scientist, who teaches at the University of Dodoma in Tanzania, said: “Each of them strongly holds onto his opinion. It is like having two bulls in one boma; they can never cope.”

Uhuru trial: D-Day set for Bensouda

HAGUE CASE ICC prosecutor’s failure to meet ultimatum may hand Uhuru team chance to file for dismissal of case



International Criminal Court judges have given Prosecutor Fatou Bensouda six days from today to confirm whether she is ready to have the trial of President Kenyatta commence on October 7. Judges Kuniko Ozaki (presiding), Robert Fremr and Geoffrey Henderson ordered Ms Bensouda to furnish them with information by September 5 on her readiness to proceed with the trial. If Ms Bensouda indicates that she is not ready to start, there is the possibility that she could ask for more time, or that a window would open for President Kenyatta to file for dismissal of the case. “Noting the importance of timely and efficient preparations and in order to provide the necessary guidance for parties and participants, the Chamber orders the prosecution to file a notice confirming whether it anticipates being in a position to start trial on the provisionally scheduled commencement date of October 7, 2014,” the order stated.

The order also requires the legal defence teams of President Kenyatta and victims of the post-election violence to file responses to the prosecution’s filing, if any, by September 10. The ICC, in its March 31 decision on prosecution’s applications for a finding of non-compliance and for adjournment of the initial trial date had set October 7 as the provisional date for the commencement of the trial. The provisional date was, however, heavily dependent on whether Ms Bensouda receives and analyses fresh evidence, President Kenyatta’s financial and property records, which her office had requested from the government.

Exam shock as Knut issues strike notice

EDUCATION | They demand responsibility cash for principals and deputies


Teachers will go on strike to coincide with the start of national examinations over their long-running pay dispute with the government. Their union yesterday gave a 21-day notice to their employer, the Teachers Service Commission, to start talks on a new pay deal or face a strike. The Kenya National Union of Teachers (Knut) said the consultative committee on terms and conditions of service — the official term for the process leading to a new deal — would cover awards up to 2017.

 Industrial unrest “Failure (to convene) would mean the employer shall be provoking teachers to an industrial unrest at the expiry of the said period,” the union said in a statement read by secretarygeneral Wilson Sossion. They teachers, who are asking for a revision of their salaries and allowances, have listed 37 demands, which include a responsibility allowance for headteachers that is equal to 60 per cent of their basic salary. Deputies should get 40 per cent and senior teachers and department heads 30 per cent. Knut wants science teachers’ allowances raised. The teachers currently get two annual salary increments, as opposed to arts teachers who are entitled to only one.

Nairobi revellers are “mourning” following the end of an era of one of the most popular clubs, the New Florida Club, popularly known as “Mad House”. Located next to Chai House on Koinange Street, the mushroom- shaped club has been going through a slow and “painful” demolition in the past few days. Pictures of the demolition have been posted on social media by people who mostly frequented the club, arousing emotions and memories of a bygone era. But the question is: Why is this club so dear to many partylovers? To begin with, all you needed to do was to have Sh500 as club entry and be over 18. “The club didn’t have a VIP section, so everybody who got in was treated as one,” says DJ Kareez, who worked in the night club for 18 years both as DJ and entertainment manager. “At ‘Mad House’, as long as you could afford a drink while inside, everyone was equal.” Most people loved the night club because of its design. “It’s round shape inside, made most first timers get lost as they tried to locate the exit,” says a reveller who requested anonymity. “One would get out of the dance floor and forget where they were seated.”

Farmers urged to heed EU warning


Agriculture Cabinet Secretary Felix Koskei has urged horticultural farmers to strictly adhere to instructions from extension officers on the use of pesticides. That would save the multibillion- shilling industry from collapse due to a likely ban in the European Union market, he said yesterday. The industry, which earned Sh83 billion in foreign exchange last year, faced a major threat after EU said it would ban Kenyan produce over improper use of pesticides, Mr Koskei said, noting that some produce was being turned away from the EU market.

 He was speaking at Magutuni market during a tour of Muringa Banana Irrigation Project in Maara constituency, Tharaka Nithi County. “We have encountered problems abroad due to farmers using banned substances while others are using excessive pesticides. “Farmers must follow what they are being asked by extension officers. Let us follow what the EU buyers are asking.” The minister cited Meru County as one of the regions where substandard produce had been detected.

Ngilu digs up 125,000 land files in clean-up.

A total of 125,574 land files that had been missing in Mombasa and Kilifi have been retrieved in a three-week clean-up of the registry. The missing files had delayed many land cases in the region, according to Lands Cabinet Secretary Charity Ngilu. The minister, who spoke in Mombasa yesterday, also announced that squatters on the controversial 930-acre Waitiki Farm would be given land and issued with title deeds. “Negotiations between the government and the Waitiki Farm owner are on and the issue would be settled by November,” Mrs Ngilu said. The minister said after inspecting the registry that the government would issue individual titles to the occupants of the land and payment made to Mr Waitiki Kamau (Waitiki Farm owner).

Mr Kamau was ejected from the farm by squatters decades ago. “I will return to the Coast region to ensure the Waitiki Farm issue is resolved by November this year,” Mrs Ngilu said. She said 38,574 files that had been missing were recovered by ministry officials at the Mombasa Land Registry during the “reorganisation” exercise, bringing the total number of title deeds in Mombasa County to 115,909. “There are also 15 cases in which minors had been allocated land. The government will not hesitate to cancel such titles.” The missing files had delayed about 7,000 cases. In Kilifi, 87,000 files and 30,000 land correspondence letters were found. “We have discovered many files that were not accounted for. However, after our clean-up exercise, we retrieved 87,000 files and 30,000 land correspondence letters. The exercise was a success and we hope the files will be of help to our officers as they serve Kenyans.

HEALTH CRISIS | Nine patients have died so far due to lack of medical care

Death and agony as strike halts treatment at hospital


Striking doctors at the Coast General Hospital have refused to resume work until all their grievances, including payment of their July salaries, are met. Patients and their relatives broke down in tears after failing to get treatment. In another tragedy baby Islam Saidi died yesterday after surgery at the hospital to open his anal passage. Doctors said he died of cardiac arrest. (See separate story). He died the Intensive Care Unit at 3am. Yesterday, patients and relatives were turned away by guards because there was no one to serve them. More than 20 patients were queuing outside the emergency ward while others lay on the floor.

A nurse, who did not want to be named, said nine people had died since the strike started on Sunday. The few doctors at the hospital were not working, with administrator Benjamin Mwero saying he was trying to convince his colleagues to resume duty. The doctors later met Dr Mwero to discuss a return-to-work formula. “They have promised me that they will resume work by the end of the day (Wednesday) but they wanted to see me before doing so,” Dr Mwero told journalists at the hospital at 12 pm.

Experts query bid to change election date.


Legal experts have questioned the bid to move the next General Election date from August to December. This follows the move by Parliament’s Justice and Legal Affairs Committee to approve a Bill seeking to amend the Constitution and shift the date of the General Election. Commission for the Implementation of the Constitution (CIC), the Law Society of Kenya (LSK) and other experts say the proposed date will not be practical as the mandate of the Independent Electoral and Boundaries Commission (IEBC) will have expired a month earlier.

CIC chair Charles Nyachae yesterday said he was not sure new IEBC commissioners will have been picked within a month to conduct polls in December. “The tenure of IEBC expires in November 2017 and I think this is a key factor MPs should have considered before changes,” Mr Nyachae, who was flanked by his five commissioners, said. Chairman of defunct Committee of Experts Nzamba Kitonga and LSK chairman Eric Mutua also confirmed the expiry date of IEBC tenure while sharing similar sentiments. “The process of appointing IEBC commissioners takes not less than three months. It is, therefore, unrealistic for anyone to say they will be able to appoint them within a month so they can conduct elections in December,” Mr Kitonga told the Saturday Nation. Mr Mutua said Kenya may consider holding future polls in December but not in 2017.

Raila starts signature hunt as MCAs fail to reach deal


Cord leader Raila Odinga yesterday dismissed the Jubilee Government’s opposition to the referendum terming it a “cheap political gimmick”. Mr Odinga said the fouryear- old constitution was ripe for amendments, pointing out that it is only through the referendum that devolution will be strengthened. “The issues we have picked will enhance equitable distribution of resources, jobs and wealth irrespective of one’s tribe, party or religion,” Mr Odinga said yesterday as he launched the campaign to collect a million signatures in Migori town. 

He had earlier conducted a fundraiser for the Kadika SDA church. “Constitutions are usually amended the world over in between general elections and not during the national polls. This is the best time to make the changes to safeguard the gains achieved through devolution,” Mr Odinga said, adding that the majority of Kenyans supported the quest for a referendum. He added that after the referendum counties could start receiving more than Sh800 billion annually instead of the current Sh226 billion.

Ruto dares Jubilee to expel him over referendum stand

Bomet Governor Isaac Ruto who is leading the push for a referendum to increase money to the counties yesterday stood his ground, saying he is not afraid to be expelled from the Jubilee Coalition because of his stand. He said he was operating independently and that the threats to expel him were baseless. “I will continue fighting for the rights of Kenyans without fear or favour. I resolved to push for a referendum after Jubilee declined to heed our plea for more funds,” he said. He said the ruling coalition and URP have never met since they came to power, yet Majority Leader in the National Assembly Adan Duale has been saying that a decision to increase allocation would have to come from a national delegates conference.

Speaking during the homecoming party for Nakuru Deputy Speaker Joseph Tanui, Mr Ruto accused Jubilee of peddling falsehoods about him that he was supporting Cord. “I am not Cord or in Cord and neither do I support Okoa Kenya. But I can welcome ideas from any quarters, Cord included, if they are good,” he said. He wondered why the government was busy demonising Cord by attributing every ill bedeviling the country to it. Mr Ruto said Jubilee must learn from history that a good coalition can be broken by a few “blue-eyed boys”, adding that there is a Jubilee “skyteam” of five who want the coalition to collapse.

 “They are misinforming President Kenyatta and his Deputy William Ruto on various issues and this is what will kill Jubilee,” he said. Mr Ruto specifically accused Mr Duale, Senators Kipchumba Murkomen and Kithure Kindiki of spreading “venom” in the country and reiterated his respect for President Kenyatta and the Deputy President. He said those accusing governors of misappropriating funds were worse “because there is Sh8 billion and another Sh300 billion that was lost in their hands”.

SPECIAL MEETING | Call to invest more money in security

Discord among intelligence agencies in Africa has largely been blamed for the upsurge in terrorism on the continent. This gap has favoured terrorist groups that have regrouped and reconstituted their cells. African Union Special Representative for Counter Terrorism Cooperation Francisco Madiera said if intelligence teams in Africa shared information, the networks would be broken and gangs weakened.

 “The AU has not been able to defeat terrorism. This is posing a great threat to the continent whose development is being sabotaged,” he said. Mr Madiera said the war on radicalisation and extremism will be won only when governments prioritise security issues by allocating more funds. “International terrorism organisations recruit the youth through the use of incentives.

“They manage to convince the young people into believing in extremist ideologies by funding them,” he said. Mr Madiera said Africa must come up with new ways of countering terror gangs that frequently come up with fresh strategies of attacking.

Army General Named as Kenya's New Spy Chief. Newspaper 21 & 22/08/2014.



Major-General Philip Kameru was appointed Director of Military Intelligence at the Kenya Defence Forces in 2006.He is a specialist in intelligence, having started out in 1979 when he was commissioned as an officer. After training as a cadet, he was posted to the Kenya Army Corps of Signals.He was appointed the commander of the unit in 2001.The general holds three Master’s degrees — Master of Science in National Resource Strategy; Master’s in International Relations and Master’s in Security Management.

Major-General Philip Kameru has been named to replace Maj-Gen Michael Gichangi
as the Director-General of National Intelligence Service. He will take office in about a fortnight, if his appointment is approved by the Parliamentary Committee on Defence and Foreign Relations.
Maj-Gen Kameru inherits a spy service criticised by police as providing information that is “too general” to be acted on. But there are deeper problems with Kenya’s security infrastructure,
among them lack of coordination between the various services.

Also, the spy service is non-executive as it is only advisory. Maj-Gen Kameru will have to contend with high public expectations that he will be able to put to an end frequent terror attacks and restore security. The true state of NIS, in terms of skills and work force motivation, is largely unknown to the public as its work is secret.

Inspiring us to rise against all Odds. Newspaper 20/08/2014


Ababu Namwamba the wolf that cannot be tamed in the ODM camp, he is causing trouble and creating more problems for the chungwa team in their agenda for a referendum. It's always good to have some rebels, misfits in our world, they inspire us to rise against all odds and make happen what we believe we here on this earth accomplish. My greatest of all times rebels who paid the price and have a legacy that will live for decades is the likes of Wangari Mathai, Nelson Mandela, Kennedy Matiba.

Kennedy Matiba is one of the unsung heroes in our country, this is what i would love my children to remember him for, He tireless fought for multi party system in Kenya, His life was constantly under threat to a point today he lost some sanity, We enjoy fruits of true democracy, thanks to him, i salute him.

Wangari Mathai, i Know you are in a special place, we salute you and love you even more. She passed away in 2011 but her memories are still fresh in us, she inspired a whole generation towards making the world a better place by planting trees, she was crazy enough to plant more than 30 Million trees and still today Green Belt Movement continue to plant trees and save our forests.

Science, Fix the Ebola situation. Daily Nation 18th and 19/08/2014


KQ finally cancels the flight to Ebola affected areas, thank God they did it, they were putting this country at risk for their love for more money. One question that begs for answers how are we going to contain Ebola? Where are this geniuses who spent years and decades in laboratories trying to figure out the next evolution of Mankind, They are well conversant with high tech science stuff which makes them admired but how can they save Africa from Ebola? We need those skills and PHD's at work to come up with a cure.

We turn to science when we cannot find answers to our problems, I personally do not like science and their crazy ideas about the future, someone once told me this " Don't talk about the future but show" Stop talking and fantasizing about about the next evolution of mankind, get down to work and find solutions to problems that we are facing today, a scientist who can gather the confidence and find the cure for Killer diseases like Aids will be a legend than the one who discovers the next phase of nano-bytes.

Why Sichagi had to Leave, the head of the intelligence department.

Joining the military was not his dream, he wanted to become a doctor, but tried hard enough to prove his teacher that he can fly.

It was a surprise to many Kenyans to see the top spy chief leave, i have a feeling that his resignation was not his call, he was forced to resign. He talked very little and listened more, he had poor work relations with the police and military, it also rumoured that he was not in good terms with the state house, Sichagi contributed to the Waki report which led to the ICC cases. Am proud of his resignation and i thank him for serving this country to the best of his ability even though he was not able to stop terror attacks, Mpeketoni and other incidents where Kenyans were brutally murdered.

The sitting President also makes the same mistakes that all his predecessors have made, is it really a digital goverment? i don't know, you tell me, he appoints old goons to serve as ambassadors i.e. the likes of Makwere and Sam Ongeri, I do not support this appointments, they are too old for that considering they are both in their 70's, when is the time for young and new fresh blood in the system? We are tired of same old folks who do nothing to change the current situation, i was opposed to the referendum but i have a feeling that it might give us some answers to our problems.

KQ will kill us all, why is Kenya airways still flying to west Africa, is it hunger for more money, is it about retaining their market share in those areas, I do not know, you tell me. The are putting our country at risk of getting infected with Ebola, World Health Organisation has already raised a red flag against the flights. They are quick to respond by saying that they have put measures in place to control the infiltration of the disease in the country but to say the truth am not sure about that.

We are in bed with the America’s again; it does not take a genius to know how bad the sitting president waited for this moment. I saw it coming and wrote an article on telling you that moving to the east openly has a price but no one cared about the post, It’s more of your Ex coming back and asking for a second chance after telling you that you are good for nothing, runs way with someone who in this case China, the new friend makes things so hard and does not care much on her/his interests, he/she finally decides to swallow the pride and get’s where she belongs. 

Let pass this message across, as much as we want to independent or want to move to the East we still need the west, there will come a time when we might not need them but that will never happen if we do not change how we do things, first step would be fast tracking development, ensuring food security, get rid of tribalism and corruption.


We need the West more than you can imagine, am not their giant fan but their interests in the country far outweigh that of East.  One day we will walk out of this chain but we need to take the necessary steps towards economic Growth and Stability.

Sincere apology to our beloved Fans.

We apologize to all fans for the several days you have missed a copy of the paper, we were having some issues but we will be sorting them out and we will be back on air.

Today in the evening all papers you have missed will be posted on the site for you to download, we apologize for any inconvenience we have caused you.

We will always keep the fire burning and ensure that we stage a revolution in the news industry, we are happy to have fans by our side who believe in this cause, we strongly believe that in our modern age newspapers should be distributed free, they have already made their money through the adverts run on the paper. Newspapers companies that have come up like X News and The people are distribution their papers for free, why can't other media houses follow the same trend? That's the question we are asking, the best part is we are not going to wait for their answers cos we are going to distribute the papers online for free. We have a plan in the pipeline to incorporate other newspaper apart from the Daily nation.

Someone asked me a question when i told him the idea of distributing free newspaper online, who is going to pay the journalist who writes the story? I told him, i don't know, but am sure the money they make from adverts is enough to cover for the cost incurred and am pretty sure they make abnormal profits, am working on this to reduce their share of the profits at the same time ensure thousands access the paper at no cost.
